Limitation of Liability
Sportsinn’s liability is limited to the purchase price of the goods and any foreseeable losses you incur due to our failure to comply with these terms. We are not responsible for any loss of income, revenue, or wasted time.
However, nothing in these terms limits or excludes our liability for:
- Death or personal injury caused by our negligence.
- Fraud or fraudulent misrepresentation.
- Any breach of obligations under the Sale of Goods Act 1979.
- Defective products as per the Consumer Protection Act 1987.
- Any other matter for which it would be illegal for us to exclude our liability.
While we use industry-standard protections, we cannot guarantee that this website is free from viruses or other malicious programs.
Events Outside Our Control (Force Majeure)
Sportsinn will not be liable for any failure or delay in performance caused by events beyond our reasonable control (a “Force Majeure Event”). This includes, but is not limited to:
- Strikes or other industrial action.
- Civil unrest, riots, terrorist attacks, or war.
- Natural disasters like fires, floods, or earthquakes.
- Impossibility of using public or private transport or telecommunications networks.
- Acts, regulations, or restrictions of any government.
In the event of a Force Majeure Event, our obligations will be suspended for the duration of the event. We will make reasonable efforts to resolve the situation, find a solution to perform our obligations, or provide a refund for products/services that cannot be delivered.
In response to government guidance, we reserve the right to change our in-store returns and exchanges policy if access to changing rooms is prohibited or limited. Please check in-store for details.
Written Communications
By using our website, you agree that our primary form of communication will be electronic (email or website notices). You also acknowledge that all electronic contracts, notices, and other communications comply with any legal requirement for such communications to be in writing.
Intellectual Property Rights
Unless otherwise specified, all intellectual property rights on this website are owned by or licensed to Sportsinn. The content on this website may not be copied, reproduced, modified, downloaded, or used in any form without our prior written permission.
Safety Warning
Physical activities can be hazardous. You are responsible for ensuring you are appropriately equipped and trained. We recommend seeking advice from a qualified person before purchasing equipment. All equipment should be used in accordance with the manufacturer’s instructions, inspected before each use, and properly maintained.
WEEE Regulations
We are committed to the Waste and Electrical and Electronic Equipment (WEEE) Directive. When you purchase a new electrical or electronic product from us, we offer free take-back of your old, like-for-like WEEE item for proper disposal. You must return your old item within 28 days of your new purchase.
All new electrical goods are marked with the crossed-out wheeled bin symbol, indicating they should be disposed of separately from normal household waste.
Our Right to Vary These Terms
Sportsinn reserves the right to revise these terms and conditions at any time. The terms in force when you place your order will apply, unless a change is required by law, in which case it may apply to previous orders. If we notify you of a change before we accept your order and you do not object within seven working days of receiving your goods, we will assume you have accepted the change.
Governing Law and Jurisdiction
These terms are governed by English law. The courts of England and Wales have exclusive jurisdiction over all claims or disputes related to these terms.
Your statutory rights are not affected by these terms.
